1.  Eligibility: The insidewink “Temecula Olive Oil Company” Giveaway presented by insidewink  (the “Giveaway”) is open to legal U.S. residents currently residing in the fifty (50) United States who have reached the age of majority (legal age) in their state of residence. In the United States, the age of majority is determined by each individual state, and can vary by several years. Insidewink will check the legal ID and state of residence of the winner and if it is found that the entrant is not of legal age to enter in their state, the prize will be forfeited and another winner shall be chosen. Employees of Temecula Olive Oil Company (“Sponsor”) and insidewink (“Host”) or any of their respective parents, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, website providers, webmasters (collectively, the “Giveaway Entities”), and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and to Sponsor and Host’s decisions, which are final and binding in all matters related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sponsor and Host reserve the right to verify the eligibility of winners.

1. How to Enter: During the Promotion Period, to enter, you must follow @insidewinker and @temeculaoliveoilcompany on Instagram and (2) Tag three friends in the comment section.  Upon completion of the rules/steps, you will automatically be entered with one (1) entry into the Giveaway. If an entrant is chosen, they must provide an address within the fifty (50) states of America to be eligible to claim their prize. All potential winners are subject to verification before any prize will be awarded. Normal Internet access, phone, and usage charges imposed by your online or phone service may apply. Automated or bulk entries or entries submitted by third parties will be disqualified. Entries must be submitted by the contestant. No copies, facsimiles, or mechanical reproductions of the Entry Form will be accepted. Entrants must complete all required information to be eligible to enter. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified. 
2. Sponsor, Host, and Sponsor and their agents, affiliates, subsidiaries, representatives or service providers may use entrants’ and/or referrals’ personal information submitted with entry for purposes of prize fulfillment and/or for future marketing by Sponsor and Host, such as to notify them of a product or promotion that Sponsor or Host thinks may be of interest. 
3. Selection of Winners: On July 15th, 2020, Host will select the username of the potential winner of the prize in a random drawing from among all entries received. The odds of winning are based on the number of eligible entries received. That winner will then be announced in an Instagram post on July 15th at 4pm PDT.  After the winner has been announced via post, the prize winner will also be notified by Direct Message (“DM”) via the instagram app and will have forty-eight (48) hours to respond with the relevant information or the Host reserves the right to select a second winner.  *Except where legally prohibited, each potential prize winner must sign and return, within two (2) days of being notified, a Declaration of Eligibility, Liability & Publicity Release (“Declaration/Release”) in order to claim his/her prize. If a potential prize winner cannot be contacted a second time via Direct Message after the first attempt to contact them, forty-eight (48) hours elapses without a response, or if potential prize winner fails to sign and return the Declaration/Release or any other required documents within the required time period (if applicable), or in the event that a potential prize winner is disqualified for any reason, Host will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible entries. Only two (2) alternate drawings will be held, after which any remaining prizes will remain un-awarded. Verification of Potential Winners: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY HOST, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE GIVEAWAY. AN ENTRANT OR EVEN ANNOUNCED WINNER IS NOT AN OFFICIAL WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.  Once the winner has received their prize, Host and Sponsor require an email or Direct Message (“DM”) to confirm that they received the package, and may be subject to send a photo for future promotional purposes. 
4. Prizes: One (1) prize will be awarded, consisting of four bottles of Temecula Olive Oil Company Olive Oil with a retail value of $100. Total ARV of prize: US$100. Prize Restrictions: Any and all applicable federal, state, provincial, territorial and local taxes and all fees and expenses related to acceptance and use of prizes not specifically stated herein are the sole responsibility of the individual prize winner. Prize cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor and Host reserve the right to make equivalent prize substitutions at their sole discretion. Sponsor and Host will not replace any lost or stolen prizes. Prizes cannot be used in conjunction with any other Giveaway or offer. Sizes of each prize component are subject to availability. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, an alternate winner will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available.
5. General Conditions: Subject to applicable law, Sponsor and Host reserve the right to cancel, suspend and/or modify the Giveaway, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor and Host’s reasonable control impairs the integrity or proper functioning of the Giveaway, as determined by Sponsor and Host at their sole discretion. Sponsor, Host, and their agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of entry will not be deemed proof of receipt by Host. Host’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS GIVEAWAY OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, HOST RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Release and Limitations of Liability: By participating in this Giveaway, entrants agree that Sponsor and Host, and their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers, webmasters, and their respective officers, directors, employees, representatives and agents (the “Released Parties”) are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use or misuse of any prize. 7. Publicity Release. EXCEPT WHERE PROHIBITED BY LAW, WINNERS GRANT TO SPONSOR AND HOST (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR AND HOST), ITS SUBSIDIARIES, AFFILIATES, RETAILERS, DISTRIBUTORS, ADVERTISING AND GIVEAWAY AGENCIES, SUPPLIERS, AND THOSE ACTING PURSUANT TO ITS AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, THE WINNER’S ENTRY FORM, NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. 
8. Disputes. Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Central District of California or the appropriate State Court located in Los Angeles, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant, Sponsor and Host in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

Privacy: Any personal information sent to, shared with or collected by Sponsor or Host in connection with this Giveaway is subject to the Host’s Privacy Policy found at https://www.insidewink.com/privacy-policy/. Sponsor, Host, and Host and Sponsor’s agents, affiliates, subsidiaries, representatives or service providers may use entrants’ personal information submitted with Entry for purposes of prize fulfillment and/or for future marketing by Sponsor, such as to notify them of a product or promotion that Sponsor and Host thinks may be of interest.
